Conditions of Entry

  1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant.
  2. Entry is only open to Australian residents aged 18 years of age and over who have purchased a Subaru vehicle and taken out a Subaru Finance contract and who hold a valid Australian Drivers Licence at the time of the draw. Employees (and their immediate families) of the Promoter, Subaru (Aust) Pty Limited ABN 95 000 312 792 / ACN 000 312 792) (“Subaru Australia”)and agencies associated with this promotion are ineligible to enter.
  3. Promotion commences at 9.00am (ADST) on 12th April 2012 and ends at 5.00pm (AEST) on 10th July 2012 (“Promotion Period”).
  4. To enter, participants must, during the promotion period, purchase a Subaru vehicle and take out a Subaru Finance contract from a participating Subaru Finance dealership to facilitate the purchase. The Subaru Finance contract must be settled and vehicle delivered by 5.00pm on 10th July 2012 for the participant to be entered in the draw (“Eligible Entrant”).
  5. The Promoter accepts no responsibility for late, lost or misdirected entries. Incorrect, incomplete or incomprehensible entries will be ineligible to enter. There is a limit of one entry in the draw per eligible entrant for each vehicle purchased and Subaru Finance contract undertaken.
  6. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry that is not in accordance with these Conditions of Entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  7. All eligible entrants will be entered into the draw to win the Major Prize. The Subaru sales consultant who referred the winner of the major prize and the Finance Manager who facilitated the finance contract will each receive a Referrer Prize.
  8. The winner will be drawn at 2.00pm (AEST) on 30 July 2012 at 15 Grosvenor Street, Neutral Bay NSW 2089. The winner, the Subaru Sales Consultant and Finance Manager will be notified by phone, in writing by email, and their names, suburbs and the Subaru dealership will be published in The Australian newspaper on 3 August 2012. The Promoter’s decision is final and no correspondence will be entered into.
  9. The first eligible entry drawn will receive the Major Prize which is a trip to Western Australia's Margaret River Wine Region and includes;
    • Return economy airfares from the winner’s nearest Australian capital city to Perth (flight associated taxes are included)

    Total maximum retail value of the Major Prize is $4,995.00.

    The Subaru Sales Consultant who referred the winning entrant to take out the Subaru Finance contract and the Finance Manager who facilitated the finance contract will each receive a Referrer Prize which includes;

    2 nights twin share accommodation in a 4 star property of the Promoter’s choice in the city of the Subaru Sales Consultant & Finance Manager’s residency.

    One dinner for 2 people to a maximum of $450 (to be supplied as an ANZ Visa Gift Card). to be decided by the Promoter and the Winner.

    Travel is not included in this prize

    Total maximum retail value of each Referrer Prize is $1200

    Total Prizepool value is $7,395.00.

  10. The prize must be taken between 6 August 2012 and 5 October 2012. Travel, accommodation and vehicle rental on the dates of travel is subject to availability at the time of booking. If availability is limited, alternative travel, accommodation and/or vehicle arrangements will be made.
  11. The prizes do not include meals other than stated, hotel car parking, other hotel incidentals, additional travel or other insurance, gratuities, merchandise or any other costs of a related, ancillary, personal or incidental nature not stated.
  12. The Promoter and Subaru Australia accept no responsibility for any variation in the prize value. The prize value is correct at 20 March 2012. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The prize is not transferable or exchangeable. The prize must be taken as offered and cannot be varied.
  13. All elements of the prizes will be arranged by the Promoter. All elements of the prize must be taken together as one trip and the winners and their travel companions must travel together. If for any reason the winner is unable to accept the prize as stated, the winner will forfeit the prize and no compensation will be given in lieu.
  14. If the winner is a Perth resident he/she will forfeit the airfare portion of the prize and no compensation will be given or paid in lieu.
  15. It is the winner’s responsibility to ensure that they have valid documentation which meets the requirements of any government authority. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements will be the sole responsibility of the winner. If the winner is, for whatever reason, unable to take an element of the prize then that element of the prize will be forfeited by the winner. Cash will not be awarded in lieu of the prize or element thereof.
  16. The Promoter reserves the right to redraw in the event of a prize winner being unable to satisfy these terms and conditions or forfeiting or not claiming the prize. If the prize that remains unclaimed or is forfeited through ineligibility or otherwise the Promoter will conduct a further draw at the same time and place as the original draw on 30 August 2012 subject to any applicable law. The winner/s (if applicable) will be notified by phone, in writing by email and their name will be published in The Australian newspaper on 4 September 2012. Dates of redemption of the major prize will be adjusted accordingly at the discretion of the Promoter.
  17. The Promoter reserves the right to request the winner to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the winner’s identity, age, residential address, email address, eligibility to enter and claim the prize and any information submitted by the winner in entering the promotion, before issuing the prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, that winner’s entry will become invalid. The prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
  18. The Promoter, Subaru Australia and their respective related bodies corporate, their officers, employees and agents shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained as a result of taking or using the prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  19. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
  20. The Promoter shall not be responsible for any entries that are not received within the Promotion Period or are otherwise interfered with due to problems with the internet or telecommunications services.
  21. If for any reason this promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any applicable law) in its sole discretion to disqualify any individual who tampers with the entry process.
  22. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the promotion and recommence it from the start on the same conditions subject to state legislation.
  23. Entrants consent to the Promoter and/or Subaru Australia using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. The winners agree to participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.

Subaru win a Real Tour Experience in France promotion

  1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

  2. Entry is only open to Australian residents aged 18 years or over who: (a) are available to take the prize between 09/07/012 and 24/07/2012; and (b) are able to elect a companion who is an Australian resident aged 18 years or over who is also available to travel between 09/07/012 and 24/07/2012. Employees (and their immediate families) of the Promoter, participating Subaru dealerships and agencies associated with this promotion are ineligible to enter.

  3. Promotion commences on 13/04/2012 and closes at 11.59pm AEST on 15/06/2012 (“Promotional Period”).

  4. To be eligible to enter, individuals must purchase, and take delivery of, any new Subaru vehicle from a participating Subaru dealership between 02/04/2012 and 15/06/2012. To enter, individuals must then, during the Promotional Period, visit www.subaru.com.au, follow the prompts to the promotion entry page, input the requested details including their first and last names, valid email address, contact telephone number, full street address, the vehicle registration number and identification number of the new Subaru vehicle purchased, agree to the Terms and Conditions by clicking the relevant box and submit the fully completed entry form.

  5. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

  6. Incomplete or indecipherable entries will be deemed invalid.

  7. Only one (1) entry permitted per person.

  8. The draw will take place at Anisimoff Legal, Suite 3, Erina Plaza, 210 Central Coast Highway, Erina, NSW 2250 on 21/06/2012 at 12.00pm AEST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winner will be notified in writing within two (2) business days of the draw and their name will be published in The Australian on 26/06/2012. The Promoter’s decision is final and no correspondence will be entered into.

  9. The first valid entry drawn will win a trip for two (2) adults to France valued at up to AU$28,900 depending on point of departure. The prize is a Cycling Australia Tour package provided by Cycling Australia (ABN 36067389259) which owns and operates Cycling Australia Tours and includes: return economy airfares from winner's nearest capital city to Sydney, NSW (if necessary); return economy airfares from Sydney, NSW to France; all return transfers; thirteen (13) nights 3.5 – 4 star twin share accommodation; a welcome cocktail briefing hosted by Scott Sunderland (subject to Scott Sunderland’s availability); three (3) dinners, to be determined by the Promoter and prize supplier, in their absolute discretion; four (4) tourism activities, to be determined by the Promoter and prize supplier, in their absolute discretion; the opportunity to attend the Tour de France Relais Etape hospitality event; the opportunity to attend the ASO hospitality L’Espace Triomphe event; the opportunity to attend a farewell function; a Cycling Australia Tour travel pack; and a $5,000 VISA card for the winner. Spending money, additional meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken to coincide with the Le Tour de France 2012 event with flights departing on 09/07/2012 and is subject to booking and flight availability.

  10. The winner and their companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation.

  11. The winner and their companion/s must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.

  12. If for any reason the winner does not take the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

  13. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

  14. The opportunity to attend any event prize is subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or their companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.

  15. Total prize pool value is up to $28,900. Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

  16. A draw for the prize, if unclaimed, may take place on 29/06/2012 at the same time and place as the original draw, subject to any directions from a regulatory authority. In the case of a winner, they will be notified in writing within two (2) business days of the draw and their name will be published in The Australian on 01/07/2012.

  17. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

  18. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

  19. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

  20. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

  21. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the Tour De France or any event awarded as part of the prize is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of the prize.

  22. As a condition of accepting the prize, the winner (and their companion/s) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

  23. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.   2. Entry is open to all residents of Australia over the age of 18 years who either: (a) have a mysubaru.com.au login; and/or (b) receive a hard copy of Symmetry Magazine or subscribe to the online version Symmetry Magazine - eSymmetry.
     
  3. Employees and their immediate families of Subaru (Aust) Pty. Limited (the “Promoter”), its agencies associated with this promotion and fleet or government buyers are ineligible to enter.
     
  4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

  8. Entrants who consent to take part in this promotion by ticking the checkbox will receive one (1) initial entry for logging into mysubaru.com.au using their Customer ID (CRM ID) during the Promotional Period.
     
  9. Entrants receive a bonus entry by indicating, via the website, their preference to switch from receiving a hard copy of Symmetry magazine to the online version (eSymmetry) by selecting the eSymmetry preference check box (for the avoidance of doubt, if an entrant has already subscribed to eSymmetry as at 01/05/2012 they cannot receive this additional bonus entry).
     
  10. The draw will take place at 12.00pm AEDST on 06/08/2012 (“Draw Date”) at Anisimoff Legal, Suite 3, Erina Plaza, 210 Central Coast Highway, Erina, NSW 2250.
     
  11. The first valid entry drawn will win their choice of either a Montblanc Star Chronograph GMT men’s watch valued at $4,800 or a Montblanc Gift Voucher valued at $4,800. (“Prize”).
     
  12. The Prize winner’s name will be published in The Australian on 13/08/2012. The Prize winner will also be contacted by telephone and notified in writing within two (2) business days of the draw.
     
  13. Total Prize pool value is $4,800. Prize is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
     
  14. A draw for the Prize if it remains unclaimed may take place on 06/11/2012 at the same time and place as the original draw, subject to any directions from a regulatory authority. In the case of a prize winner, they will be notified by telephone and in writing within two (2) business days of the draw and their name will be published in The Australian on 13/11/2012.
     
  15. The Prize is provided with a manufacturer’s warranty. Any and all claims regarding the fitness for purpose, quality, use and operation of the Prize should be directed to the manufacturer. The Promoter makes no warranties as to the fitness for purpose or merchantable quality of the Prize and accepts no responsibility for any defect with the Prize. Prize winner is responsible for any installation and set up of Prize.
     
  16. The Promoter will use its best endeavours to provide the Prize as listed. If the Prize is unavailable, the Promoter will at its absolute discretion, where possible, provide an alternative prize of equivalent value, subject to any directions from a regulatory authority.
     
  17. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
     
  18. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

Entry is conditional on providing this information. Unless the entrant indicates otherwise, the Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. In order to do this, the Promoter may share the entrant’s details with its service providers who are contract-bound to protect the entrant’s privacy. Entries are deemed to be received at the time of receipt by the Promoter and NOT at the time of transmission by the entrant.
     
  7. This is a game of skill and chance plays no part in determining the winner.  The winner will be selected by our panel of judges based on the creativity of the entry submitted.  The judges’/Promoter’s decision is final and no correspondence will be entered into.
     
  8. The prize is a Philips 23cm/9” Portable DVD Player with LCD 5-hour playtime (RRP $249.99).
     
  9. The prize winner will be notified by phone/mail and their name together with the winning entry will be published in the next edition of Symmetry Magazine.
     
  10. If any prize is unavailable or otherwise unable to be supplied, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
     
  11. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
     
  12. By submitting an entry, entrants consent to the Promoter using the entrant's winning entry (either in full or in part), name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording including to reproduce or publish such material in any medium) for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
     
  13. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
     
  14. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) redemption or use of a prize.
     
  15. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. 
     
  16. By entering the competition entrant’s are deemed to have accepted these terms and conditions and to have expressly consented to the use of their personal information for the purpose of the Privacy Act, Spam Act and other related privacy legislation. Entrant’s acknowledge and agree that the Promoter may, for an indefinite period, unless otherwise advised by the entrant, use such personal information for Promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Personal information will only be used in accordance with the Promoter’s privacy policy. The Promoter will also endeavour to provide the entrant with an option to opt out of receipt of such communications every time the Promoter contacts them. Entrants should direct any request to access, update or correct information to the Promoter.
     
  17. All entries become the property of the Promoter.
